A New York state appeals court ruled on Wednesday that New York City Mayor Zohran Mamdani can proceed with implementing an annual tax surcharge on high-value second homes. UPI, the Washington Examiner, and Fox News all reported that the decision allows the city administration to move forward with efforts to collect the tax despite ongoing legal challenges. [1][2][4]

The ruling overturned a September decision by a Staten Island judge who had sided with homeowners challenging the city administration's rollout. UPI reported that the lower court had ruled the city finance department mishandled the rollout and violated the due process rights of plaintiffs. Fox News and the Washington Examiner both reported that a four-judge appellate panel unanimously dismissed the suit after finding that the homeowners lacked legal standing. [1][2][4]

The tax on high-end second homes, also called the pied-a-terre tax, was first proposed earlier this year by Mamdani and New York Governor Kathy Hochul before being passed in the state budget, according to UPI. Mamdani became the mayor of New York City on January 1, 2026, after serving in the New York State Assembly. [1][11]
