A three-judge panel of the Ninth Circuit Court of Appeals unanimously struck down California's No Vigilantes Act on October 14, Fox News reported. The court cited the Supremacy Clause of the United States Constitution to enjoin state restrictions on federal agents with Immigration and Customs Enforcement in the case United States v. California. [1]
The panel ruled that California could not impose restrictions on the ability of federal officers to enforce federal immigration law, according to Fox News. The blocked legislation was framed by the court as an attempt to restrict federal immigration enforcement. [1]
The ruling comes amid ongoing scrutiny of Democratic Governor Gavin Newsom, who has served as the 40th governor of California since 2019. Newsom previously served as lieutenant governor from 2011 to 2019 and as mayor of San Francisco from 2004 to 2011. [8]
As FTMQ News reported earlier, California approved legislative measures during the recent session that will increase state taxes and fees by an estimated 14.3 billion dollars annually, according to a California Tax Foundation report. [2][10]
